Notice to the trustees of the will of the late Mr John Baxter of the mortgage of Mr George Baxter’s interest thereunder

To Messieurs William Edwin Baxter and Francis Snelling trustees and executors of the will of the late Mr John Baxter deceased
Take noticed that by an Indenture bearing date the eighth day of December one thousand eight hundred and sixty three made between George Baxter of Northampton Square Clerkenwell in the county of Middlesex Patentee of printing in oil colours of the one part and Edward Frederick Selle of Northumberland Place Commercial Road East in the said county of Middlesex grocer of the other part - After reciting (amongst other things) that John Baxter late of Lewes in the county of Sussex Printer Bookseller and Publisher made his will bearing date on or about the fifth day of December one thousand eight hundred and forty three (this should read 1853) and after directing his executors to pay all his just debts funeral and testamentary expenses and bequeathing certain specific legacies to his wife Charlotte Baxter the said testator devised and bequeathed all his real estate and the rest and residue of his personal estate of what nature or kind soever and wheresoever the same might be situate unto you the above named William Edwin Baxter and Francis Snelling your heirs executors and administrators during the life of his said wife upon trust to permit his said wife to receive the rents interest and other annual proceeds arising therefrom and after her decease then the said testator directed his said trustees to pay to his son the said George Baxter the sum of six hundred pounds to whom he thereby bequeathed such sum and further reciting the said will of the said John Baxter as in the said indenture is contained and reciting that the said testator made a codicil to his said will dated on or about the fifth day of May one thousand eight hundred and fifty six and thereby bequeathed the further sum of Two hundred pounds to the said George Baxter payable after the death of his said wife and in other respects confirmed his said will and reciting another codicil to the said will not affecting the said Legacies and reciting the death of the said John Baxter on or about the second day of November one thousand eight hundred and fifty eight and the probate of his said will and the codicil thereto in the district registry of Her Majesty’s Court of probate at Lewes by you the said William Edwin Baxter and Francis Snelling on the sixteenth day of December one thousand eight hundred and fifty eight - it is by the said Indenture witnessed that in consideration of Two thousand pounds to the said George Baxter paid by the said Edward Frederick Selle the said George Baxter did assign unto the said Edward Frederick Selle his executors administrators and assigns - All those the legacies or sums of Six hundred pounds and Two hundred pounds given and bequeathed to him the said George Baxter in and by the thereinbefore recited will and codicil and all the interest of him the said George Baxter therein together with full power and authority for him the said Edward Frederick Selle his executors administrators and assigns either in his or their own name or names or in the name or names and as the attorney or attornies of the said George Baxter his executors or administrators to ask demand sue for recover and receive and to give good and effectual discharges for the premises thereinbefore expressed to be thereby assigned and every part thereof and for the purposes aforesaid a substitute or substitutes from time to time to appoint and any such appointment at pleasure to revoke to have receive and take the premises thereinbefore expressed to be thereby assigned with the rights members and appurtenances thereof unto to the said Edward Frederick Selle his executors administrators and assigns and it was declared and agreed between the said parties thereto that the said premises therein expressed to be assigned to the said Edward Frederick Selle his executors administrators and assigns had been assigned to him and them in order and to the intent that the same premises and also certain other premises expressed to be conveyed and assigned to him the said Edward Frederick Selle by a certain indenture dated the Twenty fourth day of December one thousand eight hundred and fifty eight (upon which the now stating presents are endorsed) might henceforth be and remain a security for the payment to the said Edward Frederick Selle his executors administrators or assigns of a certain sum of One thousand pounds mentioned in the therein within written indenture and also of the further sum of Two thousand pounds lent and advanced by the said Edward Frederick Selle to the said George Baxter at the time of the sealing and delivery of the now stating presents and that the said premises respectively should not be redeemed or redeemable until the whole of the said principal sums of One thousand pounds and Two thousand pounds making the full principal sum of Three thousand pounds together with interest thereon as therein mentioned should have been paid by the said George Baxter his heirs executors administrators or assigns unto the said Edward Frederick Selle his executors administrators or assigns
